Our lawyer Michelle Pimenta Dezidério, specialized in Labor Law, talked to Jornal Extra about how it will be for employees regarding the Carnival holiday, in view of the cancelation of the party in several states due to the Covid-19.
The article highlights that, in the case of Rio de Janeiro, for example, only Carnival Tuesday is considered a holiday. Thus, the worker has the right to time off work or be paid at double rate for the hours worked. Monday and Ash Wednesday, on the other hand, are considered civil service holidays, and companies can choose to carry out regular work without the need for additional pay to the workers.
Michelle emphasizes that, in view of the worker's time off work, although the employer can provide guidance about coronavirus contamination, they "cannot interfere in the employee's times of rest, even if this poses a risk. No penalties can be applied for this reason."
