Our partner Flavio Aldred Ramacciotti talked to the newspapers O Globo and Jornal Extra and to the portal Pequenas Empresas & Grandes Negócios about some labor uncertainties that have been arising in view of the new wave of Covid-19 in the country.
So far, ministerial ordinances require 14 days of isolation for people infected with the virus, but some states have been declaring the reduction of the quarantine period, such as, for example, Rio de Janeiro, that has shortened it to seven days for infected people with symptoms and five days for those asymptomatic. This situation is generating uncertainties among workers and employees on how to manage the periods of work leave if they test positive.
According to Flavio, in case there is a medical certificate, it does not matter the period, the company needs to respect it even if the employee is working remotely (home office). He further suggests that, if the period of the certificate is shorter than the seven days stipulated in Rio, the company could maintain that the employee continues working from home if well until the completion of the seven or five-day leave period.
